The proposed reorganization

Shell has De Unie and its fellow unions for an explanation of the proposed reorganization at Shell International BV. On Tuesday, February 13, 2024, I sat down with HR from Shell to explain the reorganization at Shell Chemicals Europe. The reorganization at Shell International follows the same process steps. We have therefore chosen not to sit down with Shell for further explanation before the reorganization of Shell International.

De Unie and its fellow unions have asked the employer a number of questions by email in response to the proposed reorganization. We will soon receive the answers to our questions.

An employer is obliged to inform trade unions of a reorganization if the employer wants to eliminate 20 or more jobs. The jobs that are being cut almost all concern positions that fall outside the collective labor agreement.

Het proces

The employer told us that the proposed reorganization was shared with the employees in January 2024. The three requests for advice (one for Legal, one for Corporate Relations and one for Human Resources) regarding the reorganization were also sent to the works council.

The works council assesses the usefulness and necessity of a reorganization. He has also asked questions about this to the employer. Shell expects the Works Council to issue its recommendations in the week of March 11 (Corporate Relations) and in the week of March 18 (Legal and HR).

If this is a positive advice, Shell will make its intended decision a final decision shortly afterwards. For the further process, this means that where a position does not disappear, but fewer employees are needed for that position, Shell will apply the reflection principle. Reflection is done according to a fixed set of rules, which are determined by UWV.

The redundancy of the affected employees will then take effect on May 1, 2024. The affected employees are the employees who are reflected and the employees whose positions will be eliminated in any case according to the reorganization.

From May 1, Shell will follow the process as described in its National Redundancy Scheme (LOR).

Affected?

It is always annoying when you are told that you will be made redundant. If all goes well, Shell will tell the employee what exactly this means. But we can imagine that you would prefer to discuss the questions with another party.
