De Unie in action: Your temporary contract is about to expire. What are you entitled to?

This example concerns an employer who failed to comply with the notification requirement for a temporary contract that was about to expire.

The problem

Our member's temporary contract expired on March 31, 2023. More than a week before, on March 22, the employer had not yet sent written confirmation regarding the continuation or termination of the contract. By law, the employer must terminate the contract no later than one month before the end of the contract give written notice whether the contract will be extended or terminated.

If the employer fails to do so on time, the employee is entitled to a notice payment. This payment can amount to up to a month's salary if the notice requirement is completely ignored. If the notice is late, the payment can be pro-rata, for example, a week's salary if the notice is a week late.

In this situation, the employer was more than three weeks late with the notification. Our member contacted De Unie In for advice. The first piece of advice was: send an email to HR and point out that the employer hasn't yet informed you about a possible extension, even though they should have.

De Unie advised against immediately discussing compensation, as this could complicate matters if the employer still wanted to extend the contract. HR eventually responded and sent a new employment contract on March 29th, confirming the extension, but 29 days after the deadline, so too late.

De Unie advised to claim a notice payment for the period during which the notice was late, which amounts to almost a full gross monthly salary. Unfortunately, the employer initially did not comply, so De Unie formally filed the claim on behalf of the Member.

The solution

After De Unie After formally claiming compensation on behalf of our member, the employer agreed to pay the notice fee. This meant our member received what he was legally entitled to.
