Temporary contract? Discover your rights

What happens when a temporary contract expires?

A temporary contract ends automatically on the end date stated in your employment contract. However, the notice period does apply for contracts of six months or longer. Your employer must notify you in writing no later than one month before the end date whether or not they wish to extend the contract. If your employer fails to do so, you are entitled to a notice payment of up to one month's salary.

Are you entitled to unemployment benefits after your contract expires? This is possible, provided you meet the UWV requirements. We previously wrote a blog post about this (link).

Are you entitled to a transition payment?

Yes, even with a temporary contract, you may be entitled to a transition payment. This applies if your contract is not renewed at the employer's initiative. It's important to check whether your employer uses the correct calculation. Do you have questions about your right to a transition payment? The legal experts at De Unie are ready to look at this together with you.

How can you negotiate a new agreement?

Do you want to stay with your current employer? Then negotiating an extension or new terms is essential. Here are some tips to increase your chances:

  • Prepare well: Review your current performance and gather evidence of your added value. This can range from achieved goals to positive feedback from colleagues and clients.
  • Know your rights and options: Investigate the contract types available within your organization. Do you want a permanent contract or a temporary contract with better terms? Your collective labor agreement (CLA) may provide more clarity on this.
  • Be flexible but firm: Consider what's essential to you and where you're willing to compromise. Sometimes, for example, you can negotiate benefits like a training budget or more vacation days.
  • Request a conversation: Schedule a meeting with your manager or HR department. Clearly explain why you're valuable and how you see yourself growing within the organization. Use this opportunity to discuss your future plans as well.
  • Get help if you get stuck: Do you need help with negotiating? De Unie can support you with this. Our experts will help you with practical tips and legal advice.
