The problem

When the member started working for his employer in 2007, he was given a lease car – which he was entitled to according to his employment contract. He also used this car privately. He recently received a message from his employer that he was revoking the right to the lease car: the member had not driven enough business kilometers since corona. He wanted to keep this right. That's why he switched De Unie .

This has De Unie done

Precondition: in principle, an employer may not just unilaterally adjust or withdraw employment conditions. This is allowed under certain conditions, for example if there is a compelling reason for the organization. That is why we always collect all relevant information about the matter first, and we often discuss the motives with the employer. Only then can we objectively assess the situation and weigh up the various interests fairly.

In this case, the best action turned out to be to send the employer a letter on behalf of the member, in which we wrote the following:

  • The lease car has become an essential part of the employment conditions in sixteen years. Especially because the member was also allowed to use it privately and he had a fuel card with which he could pay all fuel costs.
  • Although the member no longer met the conditions for a lease car, the employer has always extended the employment condition. So for sixteen years. It is therefore very logical that the member assumed that he would retain the right to the lease car.

After the member read the letter and agreed with its contents, we sent it to the employer on his behalf.

The solution

Following the letter, the employer has decided not to withdraw the lease car.
