On holiday with a burnout, is that allowed?

Everyone is entitled to vacation. So even if you are (long-term) ill, you can take a break – while retaining your right to your full salary. In fact, it can be very pleasant to leave and be temporarily relieved of the daily grind and reintegration obligations. However, it is very important to discuss your holiday well with your employer. We explain what you should pay attention to.

Holiday request remains the same

You apply for your holiday as you always do. Your personnel guide or company regulations often state how to do this. Your employer must respond to your application within two weeks. Often you get permission, but sometimes you don't: your employer may refuse, but only for a specific and clear reason (article 'Holiday application refused'). This could be, for example, that your holiday hinders your recovery or reintegration - the so-called medical objection. To estimate this, your employer can submit this to the company doctor.

 

Consult with your company doctor

The company doctor will assess whether your holiday plans will hinder your recovery. If not, there is no problem and you can go on holiday as usual - unless your employer has another compelling reason to refuse your application. But some holiday plans can make your reintegration more difficult. In that case, the company doctor will inform your employer of this, after which he can refuse your holiday request for medical reasons.

 

Depreciation of your vacation days

Your employer may not withhold vacation days during your illness, unless you give oral or written permission for this or if this is laid down in your collective labor agreement, employment contract or company regulations. Therefore, make clear agreements about this before your holiday. This way you avoid misunderstandings.

 

No reintegration obligations

If you reintegrate, there are certain obligations and agreements that you must adhere to. Such as regularly visiting the company doctor and doing certain activities that promote your recovery. This is not necessary during your holiday. So when you're gone, you can really be gone for a while. This way you can also escape the daily grind during illness. And that could very well help with your recovery!
