Your work and income

You are not at work on time because there are no trains. What now?

NS staff is on strike. Until they achieve a desired collective labor agreement result, it is quite possible that there will be no trains or fewer trains, and you will be hindered by this in the morning. Of course, that doesn't matter much to the home workers among us, but there are still many people who do have to go to their workplace and are expected there on time. What should you do if you come to work later because there are fewer trains, or if you don't succeed at all?

What's in the law?

Unfortunately, there are no clear laws about this. In principle, as an employee, you are responsible for your own commuting. It is up to you to arrive at work (on time). So always try to do that, even if you depend on the train. Doesn't work? Then the most important thing is that you communicate this clearly with your employer.

Working from home

Do you already know the day or evening before that you will have transport problems? Then contact your employer as soon as possible and explain your situation. Discuss whether you can work from home for a day; It is also of no use to your employer if you arrive at work two hours later.

Do you only realize on the day itself that it will be difficult to show up for work? Call your employer and discuss a plan of action. Can you return home and work there, or is your employer counting on your presence, for example for an important meeting? In the latter case, working from home is difficult and it may be worth the delay. In any case, communicate the situation as quickly and clearly as possible.

Tip: come up with a good solution yourself and present it to your employer.

Record holiday

Do you miss a whole working day because of problems with your commute? Then your employer can ask you to take a day off. And do you miss part of the day? Then he can ask to take leave for that number of hours or to make up the hours. If he himself starts saying that you can safely stay at home, then it should not cost you a day off.

Check your collective agreement

Deviating rules may be included in the collective labor agreement for certain professions. For field service employees, for example, the collective labor agreement may state what your employer and you must do in the event that you do not have transport.

Tried everything?

Have you done everything possible and still can't get to work on time? And can't you work from home? In most cases you can speak of force majeure. You can't do anything about the situation. In the event of force majeure, your employer must continue to pay your wages for that day and cannot force you to take a day off. In any case, it is important to talk to your employer. Preferably in advance, to avoid discussions afterwards. Make clear agreements and ensure that everything is laid down in writing.
