Have you been fired, or has your employer suggested it? That's certainly very frustrating. But did you know that an employer often doesn't give you everything you're entitled to with the first offer? You are, in any case, entitled to the statutory transition payment. If no social plan has been agreed upon, there are often more possibilities. Why negotiating is important
If your employer offers you a severance package, it's not always the best offer. For example, you could ask for:
- A higher severance payment.
- Exemption from work during your notice period. This gives you time to find a new job. Note: Employers sometimes offer to exempt you from work, but your accrued but unused vacation days will be considered taken. This is only permitted if you agree to this in writing. In addition to the exemption, you can request payment of your remaining vacation days. If the employer revokes the exemption, the remaining vacation days will usually be paid out at the end of your employment.
- Assistance with retraining or applying for jobs.
- A good reference for new employers.
- Expiry of non-competition clause, relationship clause and/or study costs clause.
- Later end date.
Employers are often willing to offer more. This can yield significant additional benefits.
What can you do?
- Read the proposal carefully. Take your time and never sign immediately. You're always entitled to a cooling-off period.
- Determine what is important to you. Are you mainly looking for extra money? Or do you need help finding a new job quickly?
- Get help. A lawyer can help you arrange everything properly and try to get a better offer. Because it's not possible to get a better offer in every case.
