Developments in the Netherlands regarding social plans

In the Netherlands, redundancy payments have been reduced in recent years. For example, the old subdistrict court formula is no longer applied as a starting point for court rulings on dismissal, and social plans are agreed almost everywhere with the transition payment as a starting point. The transition payment is enshrined in law; the legislator decided to do this at the time because it believes that this will create more mobility on the labor market. We can find all kinds of things about this, but we do have to deal with this. On balance, this has led to cutbacks in social plans in the Netherlands, certainly with regard to reimbursements. There is more focus on the work-to-work approach, which is also the reason why the mobility budget can only be used to find a new job.

Reimbursements reduced, but return guarantee

Right from the start, Holland Casino has focused on a market-based social plan that includes a transition payment in accordance with the law. Holland Casino was not prepared to conclude a social plan with the same remuneration value as the previous social plan. Holland Casino did, however, make a proposal with an extra-statutory correction factor that results in a higher compensation.

De Unie has strongly focused on the highest possible correction factor for the transition payment. We believe that this factor should be higher when you are older and often work longer at Holland Casino. After all, when you work somewhere for a long time and are older, your position on the labor market to apply for a job is less strong.

But what De Unie has also done is strongly committed to a return guarantee. We are happy that this worked out. While retaining your terms of employment, you have the right to return within 3 years after your dismissal as a result of a reorganization. Right with this appointment is De Unie very satisfied. During the periodic consultation, we can check how Holland Casino implements this if the situation arises.

Advice

The social plans in the Netherlands are being cut back, certainly in the area of ​​reimbursements. In terms of compensation, when you compare that with the rest of the Netherlands, a good correction has been agreed. A positive point in this social plan is the return guarantee with the accompanying conditions; this arrangement is quite unique and certainly does not appear in every social plan. We present this social plan with a positive recommendation.
