The content of the social plan in brief
The social plan runs from 1 November 2024 to 30 April 2026 (18 months). The social plan applies to employees whose job is disappearing. In a personal interview, the employee concerned will be told that he or she is redundant, how the matching was achieved and what the process will look like from that moment on. The employee concerned will of course receive a letter of confirmation of the redundancy.
Guidance from "work to work"
De Unie finds good guidance and mediation from “work to work” for redundant employees of great importance. To this end, various supporting measures have been included in this social plan. The employee who chooses this trajectory will receive a personal intake interview with the outplacement agency after an information meeting. From that moment on, a trajectory will start in which the employee will be helped or guided in the search for other work. The employee who ends up in this trajectory is entitled to a termination payment.
The termination fee
The termination payment consists of the statutory transition payment increased by a factor of 2,1. The maximum statutory transition payment is €94.000 gross (in 2024), or an amount equal to the annual salary if this is higher than the statutory maximum of €94.000 gross. By increasing by a factor of 2,1, the termination payment can therefore be higher than the transition payment. However, the termination payment will never be more than €188.000 gross. The termination payment is therefore capped in the social plan.
Statutory notice period extended from 1 month to 3 months
In the event of notice of dismissal in 2024, the settlement agreement will state that the termination date will not be before 1 March 2025. This means that employees with a minimum statutory notice period of 1 month or 2 months will also not leave employment before 1 March 2025.
Trade union membership
If the redundant employee has been a member (Full or additional membership) of the company for at least 3 months at the time of notification, De Unie or another trade union, the Alfen employee will receive an additional one-off amount of €1.000 gross at the final settlement.
Going to the UWV
Of course, the option to go to UWV is also open if the employee doubts the correctness of the reflection. If UWV rules in the employee's favour, he will keep his job. If you are in this situation, please contact us first. We will then assess whether going to UWV is useful.
